Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Hunter Creative Media & Design ("Hunter Creative Media," "HCM," "we," "us," or "our"), which operates the Beacon platform as part of the CNX Suite. These Terms govern your access to and use of the Beacon platform, including the website, web application, progressive web application, and API (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

Beacon is a field operations and canvassing management platform that provides tools for contact management, territory mapping, campaign management, door-to-door canvassing, GPS tracking, data enrichment, AI-assisted coaching, analytics, and team collaboration. The Service is designed for political campaigns, sales organizations, nonprofits, and other field-based operations.

3. Account Registration

3.1 Eligibility

You must be at least 16 years old to use the Service. By registering, you represent that you meet this age requirement.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must immediately notify us of any unauthorized use at beacon@huntercreativemedia.com.

3.3 Organization Accounts

The individual who creates an organization account is the "Owner." The Owner may invite additional users and assign roles (admin, manager, canvasser). Each role has different levels of access as described in our documentation. The Owner is responsible for their team's compliance with these Terms.

4. Subscription & Billing

4.1 Plans

The Service is offered under multiple plan tiers (Starter, Growth, Pro, Business, Scale, Enterprise) with varying feature limits and pricing as described on our Pricing page. Plan features and pricing may change with 30 days' notice.

4.2 Billing

Subscriptions are billed monthly or annually in advance via Stripe. By providing payment information, you authorize us to charge the applicable subscription fees. All fees are non-refundable except as required by law or as expressly stated in these Terms.

4.3 Free Trial

New accounts may include a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. We will send a reminder before the trial expires.

4.4 Overages & Limits

Each plan has limits on contacts, team members, and other resources. If you exceed your plan limits, you may be required to upgrade. We will notify you before restricting functionality.

4.5 Cancellation

You may cancel your subscription at any time through the billing settings. Cancellation takes effect at the end of the current billing period. Your data will be retained for 90 days after cancellation, after which it is permanently deleted.

5. Acceptable Use

5.1 Permitted Use

You may use the Service only for lawful field operations activities, including canvassing, voter outreach, sales prospecting, nonprofit outreach, and similar purposes consistent with applicable law.

5.2 Prohibited Conduct

You agree not to:

  • Use the Service for harassment, stalking, or intimidation
  • Upload contact data obtained through unlawful means
  • Violate do-not-contact lists, TCPA regulations, or local canvassing laws
  • Attempt to access other organizations' data
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated scripts, bots, or scrapers to access the Service
  • Transmit viruses, malware, or other harmful code
  • Resell, sublicense, or redistribute the Service without authorization
  • Use the Service to build a competing product
  • Circumvent usage limits, authentication, or security measures

5.3 Compliance

You are solely responsible for ensuring that your use of the Service complies with all applicable federal, state, and local laws, including election laws, data privacy regulations, TCPA, CAN-SPAM, and local canvassing ordinances. Beacon provides compliance tools (DNC management, canvassing hour rules) but does not provide legal advice.

6. Your Data

6.1 Ownership

You retain all rights to the data you upload to the Service, including contact records, interaction data, and campaign content. Beacon does not claim ownership of your data.

6.2 License to Beacon

You grant Beacon a limited, non-exclusive license to process your data solely for the purpose of providing and improving the Service. This includes storing, displaying, transmitting, and analyzing your data as necessary to deliver the features you use.

6.3 Data Portability

You may export your contacts, interactions, and survey responses at any time in CSV format through the Service's export functionality.

6.4 Data Enrichment

If you use data enrichment features, your contact records are sent to third-party data providers for processing. You agree that you have a permissible purpose for enriching this data under applicable law.

7. AI Features

The Service includes AI-powered features (script coaching, note summarization, door scoring) provided through third-party AI models. AI-generated content is provided as suggestions only and should be reviewed before use. Beacon does not guarantee the accuracy, completeness, or suitability of AI-generated outputs. You are responsible for reviewing and editing AI suggestions before they are used in the field.

8. Third-Party Integrations

The Service may integrate with third-party services including mapping providers, payment processors, SMS providers, data enrichment services, and CNX Suite products (Alma, CampaignCNX+). Your use of these integrations is subject to the respective third party's terms of service. Beacon is not responsible for third-party service availability or data handling.

9. Intellectual Property

The Service, including its design, code, algorithms, documentation, and branding, is owned by Hunter Creative Media & Design and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to Hunter Creative Media's intellectual property except the limited right to use the Service as described herein.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BEACON DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEACON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE. BEACON'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO BEACON IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Beacon, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) data you upload to the Service.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or other cause, with notice where practicable. Upon termination, your right to use the Service ceases immediately. Sections 6.1, 10, 11, 12, and 15 survive termination.

14. Modifications to Terms

We may modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or through the Service. Continued use after the effective date constitutes acceptance. If you disagree with changes, you may cancel your subscription before they take effect.

15. General Provisions

15.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property disputes.

15.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.4 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Beacon regarding the Service.
